No one likes to think about death or illness.  Unfortunately, it is something none of us have control over.  It is a fact of life that we all die, and some of us may become incompetent through diseases like Alzheimer’s or an accident of some type.  You wouldn’t want anyone else to tell you what to do about your health care or your assets while you are still capable of making your own decisions.  Why would you allow someone else to make those decisions for you in the future?

Estate planning allows you to have control over your health care and your property in the future because you had the foresight to make those decisions today.  It also makes things easier for our loved ones.  For example, if you do not have a power of attorney and you become incapacitated, your family may need to file costly and time-consuming guardianship proceedings in the courts in order to manage your affairs.

Attorney Theresa M. Brennan recently returned from Atlanta, GA, where she was a presenter of an ethics session as Vice Chair of the International Ethics Committee of the International Right of Way Association at its annual meeting and education conference in June. The presentation focused on disciplinary procedures for violations of the organization’s Code of Ethics, Rules of Professional Conduct and Standards of Practice.
